When it comes to the claims settlement methods of primary and secondary liability insurance companies, it’s important to first understand the division of liability, which typically includes full liability, primary liability, secondary liability, and equal liability. During the claims process, the party with primary responsibility usually needs to cover more than 50% of the repair and compensation costs, typically around 70%. The party with secondary responsibility typically covers the remaining 30% of the costs.
In actual claims settlement, compulsory traffic insurance (CTI) will first pay out up to 2,000 yuan, and the remaining expenses will be covered by commercial insurance. For example, in a collision between two vehicles where Vehicle A is primarily responsible and Vehicle B is secondarily responsible, suppose the repair cost for Vehicle A is 10,000 yuan and for Vehicle B is 15,000 yuan. Vehicle A would need to cover 70% of its own repair costs, which is 7,000 yuan, and also 70% of Vehicle B’s repair costs, which is 10,500 yuan. Vehicle B would need to cover 30% of its own repair costs, which is 4,500 yuan, and also 30% of Vehicle A’s repair costs, which is 3,000 yuan.
In cases of equal responsibility, both parties need to cover 50% of the repair costs of the other party and 50% of their own repair costs. For instance, if the repair cost for Vehicle A is 100,000 yuan and for Vehicle B is 10,000 yuan, Vehicle A would need to cover 50% of its own repair costs, which is 50,000 yuan, and 50% of Vehicle B’s repair costs, which is 5,000 yuan. Vehicle B would also need to cover the same proportions of the costs.
In the event of a traffic accident involving a motor vehicle and a non-motor vehicle or pedestrian, if the motor vehicle is primarily responsible, it should bear 80% of the compensation liability. If the liability is secondary, it should bear 40% of the compensation liability. If there is any remaining amount after the insurance company has completed the compensation, the involved parties should compensate each other according to their primary and secondary responsibilities.
If each party’s loss does not exceed 2,000 yuan, they can each claim their own compensation. They can each contact their insurance company to make the payment through the compulsory traffic insurance. This will not affect the commercial insurance discount in the following year.
